And the fight will go on!
In a vote of 38-24, the New York State Senate has decided that gay and lesbian couples are something less than human.
The senators voted to discriminate against a large part of the population of this state that we call home. They have declared that we are somehow inferior to other people, and therefore do not deserve to have a basic human right afforded to other citizens of this state.
Amendment 14 of the US Constitution (ratified in 1868) states in Section 1 that:
All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protections of the laws.
That last sentence is in bold because it is the one sentence in the US Constitution, of US LAW, that our state senators have broken when they cast their ballots.
Within the state of New York, there is a set of laws regarding marriage called the New York State Domestic Relations Laws. Article 2 of the Domestic Relations laws specifically deal with marriage.
By denying gay and lesbian couples even this small portion of New York State Law, the senators have violated the US Constitution.
So, do we sue the State of New York and each of the those senators that voted down the bill?
NO!
In fact, I say we hit these senators and the state where it counts: the pocketbook!
Since the state of New York wants to exempt us from having equal protection under the Domestic Relations law, then I think we should be exempt from ALL New York State Laws. I am more than willing to be exempt from New York State taxes (will save me a fortune every year), from New York State traffic laws (I’ll be able to drive as fast as I want), from New York State business laws, etc.
So, here is a message to the senators and citizens of New York: Give gay and lesbian people equal protection under ALL laws, or NO laws. Your choice!
Because to deny even one law is a violation of the US Constitution, which trumps anything you can throw at us.
